1. General Terms of Use

The following General Terms govern the use and access to the website. The website’s purpose is to be PROVACUNO’s portal and to offer information, services and web content to its users. The website offers its users access to information about specific services and products, tools and applications.

The data and information about products or services, prices and characteristics as well as other relevant data offered through the website are produced, provided and updated by Suppliers and third parties. PROVACUNO is not, in any case, responsible for such data and information and does not take any responsibility related to them.

The user undertakes to make an adequate use of the contents, services, applications and tools available on the website, in accordance with the Law, these General Terms of Use and, if applicable, the Specific Terms that could be established to access specific services and applications, respecting at any time the other Users.

In the case of a total or partial breach by the User of these General Terms of Use, PROVACUNO has the right to withdraw access to the website without prior notice to the User.

2. Registration and access

In order to access specific services and tools of PROVACUNO, you need to register as a User by filling out a User Registration form.

The information and data you provide will be true and accurate, and the User will be held responsible for any false or inaccurate statements and the possible damages caused to PROVACUNO and other Users because of the information provided.

In order to access the site, the User needs to enter the User ID and password selected during User Registration. The User ID and password are PERSONAL and MAY NOT BE SHARED. The User will be responsible for keeping the custody of the User ID and password and will keep them strictly and absolutely confidential.

The User will be held fully responsible for any damages, charges for the Use of Service by third parties and consequences that may arise from the loss, theft, disclosure to third parties or breach of the custody obligations accepted by the User.

The data provided for the User Registration will be kept in a file owned by PROVACUNO and registered at the Spanish Data Protection Agency. The purpose of this file is to manage the relationships with the Users; to manage and supervise contractual relations with clients and potential clients; and to send out newsletters and offers. The personal data of this file will not be transferred to third parties without the explicit consent of the owner of the data.

The User may, at any time and free of charge, exercise his/her right to access, modify, cancel or oppose the Use of his/her personal data by sending an e-mail to the address indicated above.

PROVACUNO will take all available measures needed to prevent any type of conduct that is in breach with the Spanish Legislation and will cooperate with the competent authorities in the identification of individuals and organisations that are responsible for actions that could be in breach of the legislation applicable to this website.

By visiting our website or communicating with us through the website or by using any other electronic means of communication with us, such as e-mail and information requests, you expressly accept the use and inclusion of your data in our files for management, monitoring and promotion purposes, as indicated under “Privacy Policy”, as well as in the terms and obligations established in these General Terms.

3.- General Terms of the User
By accepting these General Terms the User expressly commits to the following:

- The User will not commit any actions aimed at undermining, blocking, damaging, rendering useless, overloading temporarily or permanently the functionality, tools, contents and/or infrastructure of the website that may interrupt its normal use.
- The User will keep custody and confidentiality of the log-in details associated to the User name. - The User is responsible for the use of said log-in details, that are personal and that may not be shared, by third parties.
- The User will not upload abusive or insulting content about other Users or third parties unrelated to PROVACUNO.
- The User will not use any of this website’s material and information for illegal purposes or purposes expressly prohibited by these General Terms or by the possible Specific Terms of Use that could be established for specific applications and/or functionalities and that are against the rights and interests of PROVACUNO, its users or third parties.
- The User will not offer nor distribute products or services, nor advertise or send unrequested commercial communication to other users or visitors of PROVACUNO.
- The User will be held accountable for any damages of whatever nature that PROVACUNO or any third party may suffer as a result from the breach of any of the obligations arising from these General Terms of Use or the Law regarding access and/or use of the website.

4.- Intellectual and Industrial Property

The website, its pages and the information or elements they contain (including texts, documents, photographs, drawings, graphics, among others), as well as logos, brands, commercial names or other distinctive signs, are protected by intellectual or industrial property rights owned by PROVACUNO or for which PROVACUNO is authorised to use it and communicate it to the public by the legitimate owners of these rights.

The User undertakes to use the contents in a diligent and correct manner, in compliance with the law, public morals and public order. PROVACUNO authorizes the User to view the information that this website contains and to reproduce it for private use (simple download and saving activities in private information systems), provided these elements are only for personal use. Under no circumstances can this be considered an authorization or licence of the property rights of PROVACUNO or the legitimate owners of the rights.

The User is not authorized to distribute, modify, transfer or communicate to the public the information contained on this website in any way and for whatever purpose.

The connections and links to third-party websites and web pages have only been established as a feature for the User. PROVACUNO is not in any way responsible for these websites, web pages and their content.

PROVACUNO shall not be held responsible for any links between the content of this website and content held either outside this website, nor for any other reference to content outside this website. Said links or references are exclusively for information purposes and do not imply in any case the support, approval, commercialization or any kind of relationship between PROVACUNO and the persons or entities who created or manage said content or who own the sites where they are held.

In order to establish links with the website the explicit written authorization by the owners of the portal is required.

6.- Responsibility

PROVACUNO does not guarantee continuous access, correct visualization, download or usage of the elements and information contained in the portal’s pages that can be disrupted, blocked or interrupted due to factors or circumstances out of PROVACUNO’S control, or to those caused by Internet computer viruses.

PROVACUNO will not be liable for any damages, harm, loss, claim or cost caused by:

(i) Interferences, interruptions, failures, omissions, delays, blockings or shutdowns, caused by errors in telecommunication networks and lines or any other cause beyond PROVACUNO’s control;

(ii) Unlawful interference through the use any type of malware or communication means, such as computer viruses or any other means;

(iii) Misuse or inappropriate use of PROVACUNO’s website;

(iv) Security or browsing errors caused by the browser’s malfunctioning or the use of obsolete versions. 

Under no circumstances will PROVACUNO be held responsible by Users or third parties for actions committed by third parties unrelated to PROVACUNO that could mean engaging in acts of unfair competition and illegal advertising or infringing intellectual and industrial property rights, company secrets, contract commitments of any nature, right to honour, personal and family privacy and image, property rights of any nature belonging to third parties, as a result of the transmission, distribution, storage, provision and receipt of content or as a result of obtaining access to content.

8.- Legislation

This Legal Notice and its terms and conditions will be governed and construed according to the Spanish Legislation. The User, by merely accessing this website or by completing the Registration Form, gives irrevocable consent to the default competent court to be informed about any legal action arising form or related to these Terms or using or browsing this website.

If any provision or section of these General Terms, which is not essential in nature for its existence, is deemed void or unenforceable, this will not affect the validity of the remaining clauses.
